TRANSCRIPT ORDERED BY: Ira Kaplan

TRANSCRIPT PREPARED BY: Christopher J. Rossi, Official Court reporter, Hudson County Courthouse, 595 Newark Ave., Jersey City, NJ 07036.

COURT: Mr. Kaplan, who do you know that's in the law enforcement field?

JUROR: My brother worked as a special prosecutor in Manhattan briefly.

COURT: He worked --

JUROR: He's an attorney, he was on a special prosecuting team on the waterfront.

COURT: What kind of work does he do now?

JUROR: Now he's not an attorney anymore.

COURT: Okay. Do you have any other relatives or close friends in the law enforcement field?

JUROR: No.

COURT: Who do you know that was a victim of crime?

JUROR: A lot of people. Myself.

COURT: What happened to you?

JUROR: Mugging, quite a few years ago, car vandalism, car theft.

COURT: Where did they all take place?

JUROR: I was mugged in Manhattan, had cars broken into both in Hoboken and New York.

COURT: Was anyone arrested in connection with any of those events?

JUROR: No.

COURT: Would any of those events or all of them combined have any effect upon your ability to be a fair juror?

JUROR: No.

COURT: Is this your first experience as a juror?

JUROR: Yes.

COURT: Would the nature of these charges create any prejudice or sympathy in you for or against either side?

JUROR: No.

COURT: Would you give any greater or lessor weight to the testimony of a law enforcement officer because of that person's job?

JUROR: No.

COURT: May I see you here at the sidebar for a moment, please?

(the following takes place at the sidebar)

COURT: Why is it that your brother's no longer an attorney?

JUROR: He didn't really like it.

COURT: Oh, just gave it up.

JUROR: Yeah, he's selling wine now.

COURT: He wasn't disbarred.

JUROR: No.

COURT: Okay. Al right, fine.

(the following takes place in open court)

COURT: All right, Mr. Kaplan, would you tell us some things about yourself?

JUROR: I live in Hoboken. I play in a rock and roll band and I'm married and my wife is in the same band.

COURT: Wife is what?

JUROR: Is in the band also.

COURT: Oh. Give you a chance to advertise, what's the name of your rock and roll band?

JUROR: Yo Le Tango [sic].

JUROR: Do I get a copy of that? Can I get a copy of this for our press kit?

COURT: Thank you.
